Terms of Service

Important Medical & Health Disclaimer

Moodie is designed strictly as a personal wellness, lifestyle habit, and self-reflection companion. Moodie is not a medical device, clinical diagnostic tool, psychiatric therapy provider, or suicide/crisis prevention service. If you are experiencing a mental health emergency or severe distress, please contact professional medical personnel, emergency services (such as 911 or your local emergency number), or a crisis lifeline immediately (e.g., dial 988 in the US/Canada).

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Moodie App Inc. ("Moodie," "we," "us," or "our") concerning your access to and use of the Moodie mobile application, cloud API services, and associated websites (collectively, the "Service").

By creating an account, downloading, or using the Service, you signify your agreement to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility & Account Registration

To use Moodie, you must be at least 13 years old (or the legal age of majority in your jurisdiction). By registering, you warrant that:

  • You will provide accurate, truthful, and current registration information.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You will notify us immediately at support@moodie.app upon discovering any unauthorized use of your account.

3. User Content & Ownership

Your emotional entries, personal journal notes, water logs, and menstrual cycle records belong to you ("User Content").

  • You Retain Full Ownership: We claim no intellectual property rights over the notes, feelings, or tags you record.
  • Limited Service License: You grant Moodie a limited, non-exclusive, revocable license strictly necessary to store, encrypt, synchronize, and display your User Content back to you across your authorized devices.
  • No Public Sharing: We do not publish, index, or make your User Content publicly available to other users.

4. Intellectual Property of Moodie

The Moodie brand, visual design, custom leaf mark, software code, UI interfaces, illustrations, gamification badge mechanics, and API documentation are the exclusive intellectual property of Moodie App Inc. and are protected by copyright, trademark, and applicable intellectual property laws. You agree not to copy, reverse engineer, decompile, or create derivative works of our software.

5. Acceptable Use Policy

When interacting with the Service or developer API endpoints, you agree NOT to:

  • Attempt to probe, scan, or compromise the vulnerability of our authentication systems or backend servers.
  • Transmit viruses, malware, malicious code, or conduct denial-of-service attacks.
  • Scrape, bulk-extract, or harvest data through automated means outside the documented developer API rate limits.
  • Impersonate another user or access an account without express authorization.

6. Service Availability & Modifications

We strive to keep Moodie fast, reliable, and available around the clock. However, we do not guarantee that the Service will operate without interruption or errors. We reserve the right to modify, update, or discontinue certain features or API endpoints with reasonable notice when possible.

7. Termination & Account Cancellation

You may stop using the Service and delete your account at any time via the in-app settings. Upon account deletion, your journal entries and personal data are permanently purged from our active databases.

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive activities that endanger the security of other users or our platform.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODIE APP INC., ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
